Introduction
This document (the “Terms”) together with the U.S. Privacy Policy (collectively the “Agreement”) sets out the terms and conditions governing visits, access and use of the service by the end user (“you”). The Service Content is the property of our site and/or third parties and is protected by copyright under both United States and foreign laws.
User content
To the extent allowed by the Services, any musical works (sound recordings and underlying musical compositions), audiovisual works (including but not limited to MTV style premium music videos, clips and so called “behind the scenes” audiovisual content), other video or audio works, images, graphics, text, works of authorship, files, documents, applications, artwork, trademarks, trade names, metadata, album titles, sound recording titles, artist names, intellectual property, or materials relating thereto or any other materials that you submit to the Service (“User Content”) are generated, owned and controlled solely by you and/or your licensees. We do not claim any intellectual property ownership rights in any User Content. After directly sending (“submitting”) your User Content to the Services, you continue to retain any intellectual property ownership rights that you may have in your User Content, subject to the license below.
Rules for Uploading Music
By uploading music to Musicityfy.com, you agree to comply with the following rules. Failure to adhere to these rules may result in the removal of your content or termination of your account, as well as potential legal consequences:
Musicityfy.com is not liable for abuse of intellectual property rights by its users. Users are required to report any unauthorized use of their work on the platform.
Ownership of Content
You must be the direct and sole owner of the music you upload, or you must have explicit written authorization from all rights holders (e.g., co-creators, performers, publishers) to distribute the content on Musicityfy.com.
By uploading, you affirm that you hold all rights necessary to grant Musicityfy.com the right to host, display, and distribute the uploaded content.
Copyright Compliance
Musicityfy.com is not responsible for verifying ownership or authorization for uploaded content.
Any disputes regarding copyright infringement will be resolved between the claimant and the uploader. Musicityfy.com will comply with applicable copyright laws, including removing content in response to valid takedown requests under the Digital Millennium Copyright Act (DMCA) or other relevant legislation.
Prohibited Content
Do not upload music that infringes on the intellectual property rights of others, including copyrighted music, samples, or recordings to which you do not own or have proper rights.
Do not upload music that contains explicit material prohibited under applicable laws, including hate speech, illegal activities, or otherwise harmful content.
Responsibility for Uploaded Content
You are solely responsible for the music you upload and any consequences that arise from its distribution.
By uploading, you indemnify and hold Musicityfy.com harmless from any claims, damages, or liabilities arising from your uploaded content.
Removal of Content
Musicityfy.com reserves the right to remove or disable access to any content that violates these rules, applicable laws, or the rights of others.
Repeat violations may result in account suspension or termination.
Grant of License
By uploading music, you grant Musicityfy.com a non-exclusive, worldwide, royalty-free license to host, stream, and distribute the content on its platform in accordance with these rules and any applicable user agreements.
Abuse of Property Rights
Musicityfy.com is not liable for abuse of intellectual property rights by its users. Users are required to report any unauthorized use of their work on the platform.
